The Failure of the 28-Clause Peace Proposal for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the tension caused by the presentation of a new 28-point plan for resolving the conflict appeared – momentarily – to have been defused. A Washington representative spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its retaliation: an extensive attack of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The succession of conflicting incidents captured the harsh reality of the recent timeframe. By day, diplomatic battles are fought: positive announcements are released from different nations. Significant resources is devoted on managing specific proposals. By night, the Kremlin brutally reminds the world that, for them, military action persists as the main instrument for achieving "resolution".

After-Dark Attacks

As the offensive developed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was laid bare. Ukraine is able to track missile launches from Russian territory, a capacity afforded by current data. From witness perspectives, defense planes that had been scrambled to engage hostile cruise missiles flew past – modern combat jets provided to Ukraine by NATO members.

Shortly after, Kyiv's anti-aircraft weapons engaged: defensive missiles deployed against a Russian ballistic missile. This was a sophisticated defense system at work, probably provided by Western nations. Every deployment jolts you unexpectedly, rattling buildings. The moment of terror quickly transforms into grim resignation: maybe the incoming missile won't strike its target this time, sparing the city from catastrophe and another blackout.

Ongoing Risks

Soon after, a large-caliber weapon engaged a drone close by, part of a defensive team – most likely imported technology. Sadly, the shots failed to hit the hostile drone – it pressed on overhead toward its objective.

Intermittently, this continued until dawn. Kyiv greeted the daybreak reports: seven people killed, damage and utility failures in numerous residences as a result of the night's assault. As customarily, everyone still went about their day – living the war. But those full day illustrated Ukraine's essential dependence on international aid – a need that European nations are demonstrably unable to substitute in the near term.

Unsuccessful Negotiations

The comprehensive proposal from Washington generated strong feelings, controversy and deep concern – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after prior negotiation attempts and multilateral gatherings.

Every new proposal from US leadership adheres to the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They contain the crisis but never actually achieve victory. This cycle will, undoubtedly, endure.

Political Considerations

It is tempting to accuse specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the entire situation. US administration operates on a assumption understood by experienced diplomats: you cannot secure via talks what you have been unable to protect through force. The American government believes that it is impossible to force Russia to surrender the land that it already controls in Ukraine's south or east.

The challenge is that while acknowledging this situation, American administration does minimal to prevent Kremlin actions, through words or deeds, from believing that the current condition will not shift further in its benefit in the near future.

Conflicting Perspectives

Therefore, the Kremlin is certain that time is on his side – that Ukraine and its supporters are approaching exhaustion. Their reason to accept conditions that does not give them the maximum possible gain is virtually nonexistent. There may be numerous efforts to stop fighting, but they will carry on as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Kyiv believes that Ukraine can still endure, slowly losing people and territory but preventing a complete military breakdown until conditions improve in its favour.

Present Conditions

Factually, there are no real preconditions for a armistice. Now, personal considerations are entering the equation: personal goals to mediate resolution and secure international recognition, and Kyiv's dual difficulties – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the country's interests against any plan Kyiv finds unacceptable, so that their priority does not move to internal issues. And although their mission will now be significantly challenging after recent developments, it remains highly unlikely that this will change their overall approach.

These opposing factors are guiding negotiations.

Assessment and Future

It took a only one week to kill the suggested clauses of the current initiative. Aggressive and erratic handling of the matter by American leadership, resistance by Ukraine and the remaining European nations, along with calming attempts of negotiators, and finally, current information leaks, all did their job.

While new initiatives based on old ideas are approaching, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are rooted in Kremlin requirements and demonstrate certain reluctance to modify developments, if they maintain solidarity and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the coming months, largely rely on sustained allied backing.
